Please read these terms + conditions carefully before placing any orders on www.finchandagnes.com. By placing an order, you enter into an agreement with us and accept these terms and conditions.

It’s in Finch + Agnes’ interest to ensure your satisfaction with our service, for which reason we will make every effort to follow up commitments taken on with you. If you have any doubt or suggestion you can contact us always through [email protected]. We’ll be glad to help you.

GENERAL TERMS + CONDITIONS

All rights, obligations, specials, orders and agreements that fall under these General Terms + Conditions, and under this condition, are applicable under Dutch Law and Jurisdiction.

1. General

These conditions apply to all sales and agreements between Finch + Agnes and the customer, whereby Finch + Agnes will apply these conditions unless agreed otherwise in writing. If products are ordered from Finch + Agnes, the purchaser automatically accepts the stipulations set out in these General Terms + Conditions.

2. Orders

Once an order has been placed, the customer will directly receive online confirmation on his screen at the end of checkout, as well as an email to confirm the details of the order and the total costs associated with the order. All orders will be sent within five working days after receipt of payment by the customer. In the case of technical malfunction, however, which falls under the category of circumstances beyond Finch + Agnes’ control, an order will be shipped as soon as possible. Finch + Agnes will keep the customer duly informed of the status of the order.
We strive to keep our website www.finchandagnes.com as current as possible. However, the possibility remains that a certain product is no longer available, in which case we will contact the customer as soon as possible. We will give the customer information about alternative products with similar features, quality and price, reserving the customer the right to accept the replacement product. If the customer is not interested in the product offered by Finch + Agnes, we will proceed to refund any amount which the customer has paid.
A product must be delivered to the customer within 30 days of the order placement. If Finch + Agnes fails to comply with this, the customer may immediately break the order contract. This is not possible, however, if the parties involved have previously agreed to a different delivery term.
Finch + Agnes reserves the right to restrict multiple quantities of an item, or of orders, being shipped to any one customer or postal address.
Once a customer’s order has been placed and the customer has received an order confirmation email, he may not make any changes to the order. If he wishes to make changes to the placed order, or if there is any mistake made in registering customer contact or address details when placing the order, it is his responsibility to contact [email protected] immediately.

3. Prices and payment

The prices of the Finch + Agnes’ items are in Euro’s and include value added tax. Shipping costs and custom duties are not included in the price. The regular payment we accept is PayPal and credit card (Visa, Mastercard or American Express). Credit card payment is made with our partner Stripe. Our payment method is secure: fully SSL encrypted and PCI compliant. This security system guarantees confidentiality and holder authenticity and prevents unauthorized third parties from gaining access to your information. The customer is required to provide payment details that represent and warrant him are both valid and correct. If the customer wishes to pay by bank transfer, this is also possible. The order in this case will be placed via e-mail. Shipment of the order will take place once Finch + Agnes has received payment for the order. Finch + Agnes will add the shipping costs to the invoice of the order. More information concerning the shipping costs can be found on the FAQ page.
International shipments outside the European Union could have some duties and taxes once the shipment reaches the delivery country. Finch + Agnes cannot control or predict these charges, therefore it is our customer responsibility to pay any additional charges for customs clearance.

4. Shipping

The shipping time is indicative and is therefore not guaranteed. The order will be processed and shipped within five working days of receiving payment. Finch + Agnes cannot be held responsible if the shipping company is unable to deliver the order to the customer on time.
If the package is damaged when it arrives, please contact us within 24 hours through [email protected] and we will contact the shipping company.
Finch + Agnes will not pay shipping for uncollected packages. We will charge the customer for the cost of the return shipping and administrative costs.

5. Transfer of ownership

Ownership of merchandise will not be transferred until the associated obligations of purchaser have been fulfilled. At the point of transfer of ownership, which is at the point of delivery of the products, product liability is transferred to the purchaser.

6. Money back guarantee

If the customer, for whatever reason, does not wish to retain the product, the customer has the right to return the product to Finch + Agnes within seven working days after taking delivery of the product. The customer must follow all return conditions and instructions stipulated by Finch + Agnes on the FAQ page. This guarantee does not comply if the product has been worn or washed, or if the customer has attempted to mend or alter the product in any way. Return products will only be accepted if they are sent in the original, undamaged wrapping and the labels are still attached to the products. Furthermore, the shipping costs of the returned merchandise will be entirely paid for by the customer. Under no circumstances will Finch + Agnes reimburse the shipping costs of returned merchandise. If the return instructions have been followed accurately, Finch + Agnes will reimburse the customer for the returned product(s) within thirty days after receiving it. Finch + Agnes will nog accept returns for SALE products.
For faulty products Finch + Agnes will make a full refund to the customer, including the return shipping, as soon as possible upon receipt of the products and within thirty days, beginning with the date of receipt of the products. Products are faulty if they are received in the wrong style or size – as a result of a mistake made by Finch + Agnes –, damaged or where a manufacturing fault occurs within six months of purchase. Items that are damaged as a result of normal wear and tear are not considered to be faulty. If a customer would like to exchange a faulty product instead of obtaining a refund, the customer needs to be aware that we can only replace it for the same product in the same size, subject to availability. Where possible, we will offer to repair faulty products. If it cannot be repaired or the same product is not available, you are entitled a full refund, shipping and return included.

7. Queries / Complaints

In the case of queries or complaints concerning any of our products or procedures, please inform us by email ([email protected]). You will receive a reply within three working days.

8. Privacy

Finch + Agnes finds it very important to ensure that all of the customer’s personal information is treated with the utmost care and security. Finch + Agnes will not give the customer’s personal information to third parties, except when the information is required for the delivery of the order.
When making an order, Finch + Agnes requires the customer’s name, invoice and delivery addresses, and payment details so that an order can be processed. The payment details will only be used to conclude the payment process.
Records of website visits are kept for statistical purposes. Information concerning the amount of visitors and visitor frequency to our website will be used for internal research and website improvement. However, this general information is anonymous and cannot be traced back to the individual visitor.

9. Liability

All products in the assortment of Finch + Agnes have been produced with the greatest care. Finch + Agnes cannot assume any liability for damages in any form whatsoever, either physical, material or immaterial, that can be caused by malfunctioning or ill use of the products sold by Finch + Agnes and / or materials or accessories becoming undone.
The content of the website has been compiled with the greatest care. However, Finch + Agnes cannot preclude the possibility of any error or incompletes in the information on this website. Finch + Agnes cannot assume any liability for the consequences of incorrect or incomplete information on the website. Finch + Agnes cannot be held responsible for any typing or misprinting errors that could communicate an incorrect selling price. In that case Finch + Agnes will adjust the price as soon as possible. The actual colour of the products can differ from the colours shown on the computer screen. Finch + Agnes cannot be held responsible for variations in colours as a consequence of the quality of the computer screens. The position and size of the actual applications on the clothes can differ slightly from the display on the website. Finch + Agnes cannot be held responsible for this.
Certain links on the website can give access to websites and information that is being exploited and maintained by third parties. Finch + Agnes does not control these sites and it not responsible for the content of these sites.

10. Force majeure

Despite any other established legal rights, Finch + Agnes is entitled, at its own choice, in case of force majeure, to cancel your order, or cancel the purchase agreement without legal intervention, by informing the customer in writing. Force majeure is understanded to mean any act, event, omission or accident which is beyond reasonable control. The customer is not entitled to any damages, unless given the circumstances this would be unacceptable according to measures of reason and fairness.
